RULES 1. GENERAL 1) These RULES contain the general principles related to the Website Communities operated by KOTRA. 2) The Website Communities operated by KOTRA are a free service provided to users who agree to comply with these RULES. A user of the said service ("a user" hereinafter) shall be deemed to have agreed to comply with these RULES. 3) These RULES shall take effect once their contents have been displayed on KOTRA's community homepage and agreed upon by a user. 4) KOTRA reserves the right to make an amendment to these RULES as long as such an amendment is not in violation of the laws pertaining to in-house rules of a private organization or promotion of the use of the information & telecommunication network and protection of information. In the event of an amendment, KOTRA shall make the relevant notice, including the date of application, reason for amendment and contents thereof, on the initial screen of the community homepage at least seven days in advance of the application. 5) The amendment as stated in the foregoing (number 4) shall apply equally to all members, including those who became members before the amendment. A member who has an objection to an amendment to these RULES may apply for withdrawal of his/her membership at any time. 6) A member who continues to use the service after the date of application of an amendment to these RULES shall be deemed to have agreed to it. 2. Responsibility of Community 1) KOTRA shall not be held responsible for any community generated by the Community or any information or contents of the materials displayed on such a community. All possible results from the contents of any material displayed on such a community shall be the responsibility of each user. 2) KOTRA reserves the right to transfer a community according to its own method of classification without prior notice. 3) KOTRA shall not be held responsible for any loss incurred by a user due to the information contained in the service. 3. Role and Rights of Community Manager 1) The Community Manager reserves the right to represent his/her community and grant or reject a membership regardless of what is stipulated in the internal rules of the relevant community or the fraternity association. 2) The Community Manager reserves the right to put a certain limit to the display of, reject the registration of, or delete, materials or information that do not comply with the purpose of KOTRA's operation of the community. 4. Responsibility of Community Manager 1) The Community Manager shall be held responsible for a problem under either Civil Law or Penal Code that may be caused due to neglecting his/her duty to apply rigorous control over the displayed materials that are in violation of relevant laws or regulations or do harm to the public morale. KOTRA reserves the right to ask the Community Manager to put a limit on, or delete, material or information deemed to be in violation of relevant laws or regulations or that does harm to the public morale. In the event that the Community Manager appears not to comply with such a request from KOTRA immediately, KOTRA may take an action to delete or put a limit on such a material or information and notify him/her of the action taken. 5. Management of Community Members 1) A user of Digital KOTRA is free to apply for a membership for a community. 2) Either the Community Manager or a Community operator reserves the right to accept or reject the application for a membership in consideration of the relevant policies and rules. 3) The Community Manager may entrust the matter concerning management of the members to either the Deputy Community Manager or a Community operator. 4) Either the Community Manager or the Community operator that manages the members on behalf of the Community Manager shall not disclose any personal information of a member without the member's prior consent. The Community Manager shall be held responsible for any result that may be caused due to arbitrary disclosure of personal information of a member. 6. Rules on Operation of Bulletin Board 1) Management and operation of the bulletin board shall be the responsibility of the Community Manager or the Deputy Community Manager designated by the Community Manager. 2) In the event that one of the following is displayed on the bulletin board of a community, the relevant Community Manager shall delete it and give a warning to the member who put it on the bulletin board. - Material containing a request for (or for exchange of) commercial, illegal or sexually offensive contents - Material (related to an act infringing upon others' rights) that is asked to have deleted by the interested party or concerning which KOTRA may be sued or charged - Material that is asked to have deleted by a state organization in accordance with a law or regulation pertaining to electricity and telecommunication or the Penal Code 7. Rules on Operation of Data Room 1) A user shall not register any commercial material or material that does harm to the public order or public morale or infringes upon intellectual rights. A user that registers such material shall be wholly responsible for any result that may be caused by such material. 2) Each Community Manager shall constantly monitor what happens on each data room and immediately delete a commercial, illegal or sexually offensive material upon finding it or receiving a report on it. 3) A community that is found not to take proper action immediately on a commercial, illegal or sexually offensive material shall be automatically closed. 4) Standards on Deletion of Materials on Data Room ¨ç Commercial Material - Material related to a product sold, either currently or in the past, in Korea - Material related to a product for which a Korean business made a license contract - Material related to a product being sold in a foreign country ¨è Material Whose Intellectual Rights Shall be Protected - Material whose producer does not want it to be distributed - A crack or patch material that removes the limits put to the function of shareware or a demonstration program ¨é Damaged Material - Material affected by virus or containing data affected by a virus - An intentional or ill-intentioned BATCH file or an execution file transformed from a BATCH file ¨ê Sexually Offensive Material - Material with sexually offensive contents - Material in violation of the Electricity & Telecommunication Act Article 53, the Enforcement Ordinance of the said Act Article 16 (Subversive Communication), and the Telecommunication Business Act Article 53 Paragraph 3 ¨ë Other Improper Materials - Material giving information on a site containing sexually offensive or commercial contents 8. Use of Materials or Data Displayed on Community 1) Certain materials or data may be provided by KOTRA via separate service menus for PR of the community or protection of the rights of ordinary users. 2) The intellectual right to a material or data displayed on a community shall belong to the party that has registered it, provided that this shall not apply to material or data originating from another party entitled to it. 3) Materials or data displayed on a community shall not be used for commercial purposes. However, commercial use of material by its registerer shall be decided upon by the registerer. 9. Warning and Closure of Community KOTRA reserves the right to close a community in the event of the following: 1) When it has been established for a purpose that does harm to the social order or public morale or for exchange of information on sexually (or otherwise) offensive materials 2) When it is engaged in an activity in violation of the Constitution or laws or regulations 3) When it clearly does harm to the users 4) When the Community Manager neglects to protect the members or fulfill his/her responsibilities 5) When a problem is found to be unresolved after receiving two warnings and an order to stop the operation 6) When remedial action is not taken after a material that does harm to the public order and morals is registered 7) When a request for remedial action is not complied with after a commercial material or a material protected by the intellectual rights is registered 8) When the Community Manager is not in touch with KOTRA for three months in a row 10. Stoppage of Operation of Community Operation of a community may be stopped temporarily in the event of the following: 1) When there is an order for preservation of evidence from a state organization due to occurrence of an event related to violation of a law or regulation 2) When a problem is found to be unresolved after receiving two warnings 3) When there is an inevitable reason for such stoppage due to a particular situation of KOTRA 4) When KOTRA plays the role of the arbitrator at the request of the parties involved in a dispute concerning a community (Additional Rules) These RULES shall take effect from January 1, 2003.
